Banned from Pomona's Campus For Exercising their Rights



Above are the emails from Dean Marcelle Holmes to Kyle Kinneberg CMC '09 and David Daleiden CMC '11. Kyle's email says much the same thing as David's.

The two of them have been banned from Pomona College for videotaping a public lecture, even though the law allows them to. They are also required to turn in all videos that they took at Pomona College. I'll have more as this develops.

I don't like what these people did from an ethical standpoint, but Charles, I'd be more than willing to help you organize/start a free speech protest to be held at the 5C's. If Pomona had simply asked for the tapes back, it'd have been one thing, but banning two people from the entire campus of Pomona for doing something that was within their legal (thought not ethical imo) right is complete overkill. Then there is the request to not release the emails of people in attendance. There are few things I support you on but this is one of them.

I for one think we should focus a cyber harassment campaign against the students in attendance to spite the Pomona administration. I know this is 100% legal, and I can cite precedent (we can even lie as long as the lie is not about actual facts http://arstechnica.com/tech-policy/news/2008/02/appeals-court-first-amendment-protects-forum-trolls-too.ars) is protected. I am vehemently pro choice but Pomona has acted in an illogical, punitive, and offensive manner. They should retract some of these requests as well as all of the punitive aspects of this letter. I HOPE you change that stupid free speech thing on your front page to a red light for Pomona.

Also, David. I think I found a loophole. The email is supposed to "serve as notice" that you are banned from Pomona. If you wanted, you could just be a dick and deny ever reading the email. I'm not sure if that would work but I'd give you $10 to try it.

For once, I stand with Charles on this one and think Pomona is being irrational. I'm also pro-choice, but Pomona shouldn't advertise an event across the 5Cs if they don't want to ever hear any opposing views. Although David didn't act in an ethical manner, the legality of his actions remain intact.

Poor taste isn't grounds for kicking someone off your campus.

All the campuses have, at some point or another, utilized this ability to unilaterally ban a student of one of the other 5-Cs. Being private property, they really don't even have to have a reason.

But usually when one of the 5Cs bans someone it's because they're a real danger or actually obnoxious. Asking questions you don't like, at times you don't like, can hardly rank up there with past justifications.

The whole "it's their land, it's their rule" argument makes some sense when Pomona doesn't participate in a consortium. But the whole notion of the consortium is reciprocity. I doubt Oxtoby or Gann want the relationship between the school to disintegrate into competing extradition claims or some other nonsense.

I'm certainly not saying I agree with Pomona's actions here. I'm just saying that technically, they've got the right, and they aren't doing anything the other deans haven't done before. Sure, most of the folks who get banned are dangerous-ish, but not always. Alcohol poisonings, streaking, hell, even just drunkenly hollering at a student can get you banned, depending on the dean in question.

And I'd be very surprised if either Oxtoby or Gann is even really cognizant at this point of what a shitstorm this is turning into.
